The company

• must be an active and trading overseas business.
• must continue to have its head office and main business operations outside the United Kingdom.
• must intends to establish a wholly owned subsidiary or a branch office in the UK.

The company who is applying to open a branch office in UK must meet the criteria of geniuses; 

• foreign companies must be a practically active business unit.
• headquartered must be outside the United Kingdom. 
• line of business must be the same as the UK subsidiary or wholly owned subsidiary

Foreign companies must strive to maintain their main business centres abroad. If your UK subsidiary or subsidiary is proven to be doing well, it does not mean that you should refuse to do business abroad, as this covers your initial long-term contract.

Sole proprietor or  majority shareholder of the business is not eligible to apply for UK Sole Representative Visa

The sole representative must apply for the establishment and regulation of a company in the UK; owned by a foreign company he/she represents. The UK branch office must have a lawful business and the sole purpose should be to extent the parent company business. If licenses are already valid in the area and an extension of stay is requested, the facility must already be operational in the UK.
